Justice Scalia’s Anti-Pot Remarks a Supreme Concern

Supreme Court Justice Antonin Scalia doesn’t appear to be a fan of state marijuana legalization laws.
Asked on Wednesday night about the conflict between state and federal marijuana laws after a speech at the University of Colorado in Boulder, Scalia noted that “the Constitution contains something called the Supremacy Clause,” according to the Associated Press. He didn’t elaborate much, however, out of concern that “it would force me to have to recuse myself” if a case concerning the issue reached the Supreme Court.
And that may well happen.
Under the second term of the Obama administration, the federal government has been largely deferential in letting states implement their own marijuana laws despite the conflicting Controlled Substances Act.
